New Ergani requirements for employers

The Minister of Labour and Social Insurance, pursuant to the Transparent and Predictable Working Conditions Act of 2023 (25(I)/2023) (the “Law”), has issued a decree introducing a significant regulatory change. This change establishes a mandatory requirement for employers to register the essential terms of employment for all employees in the Ergani system. The registration period runs from January 2 to February 28, 2025.

 

Essential terms of employment include, among others, the commencement date of employment, salary, working hours, probation period, and other key contractual conditions as defined in the decree.

 

To use the Ergani system to register employment terms, employers must be registered users. The process begins by ensuring that each employment relationship is correctly entered in the Social Insurance Services system under your employer registration (AME). You must first submit the hiring declaration for each employee, as the system only allows input of employment terms for registered hires. This data will be accessible through the "View Employment Details" section in Ergani.

 

To add employment terms, select "Employment Terms" from the menu and choose "Add.". To proceed, choose "Submission Process = Employment Terms" and enter the employee's Social Insurance Number. Once entered, return to the previous screen and click "Locate" to access the form for entering terms.

 

The form will display prefilled data from previous submissions, which you can modify if necessary. You can save your work without submitting or complete the submission immediately. Saved entries can be retrieved later under "Search Employment Terms", allowing further edits or final submission.

 

Although the decree does not specify direct fines for non-compliance, under Article 27A of the Law, employers who fail to provide required records or documentation may face penalties. These include imprisonment for up to six (6) months, or a fine of up to EUR 10.000, or both.
